Introduction

SkillStorm Commercial Services, LLC ("SkillStorm," "Company," "we," "our," or "us") respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes how we collect, process, retain, and disclose personal data about you when you use or interact with our website at www.skillstorm.com and its subdomains, and any other websites, applications, or services that link to this policy (collectively, our "Services"), and our practices for using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect:

  • Through the Services, including when you submit a form, apply to a training program or job opportunity, or request information from us.
  • In communications, including email, text messages, chat, and other electronic messages, between you and the Services.
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by SkillStorm or any third party (including our affiliates and subsidiaries) that does not link to this policy; or
  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the Services.

We may provide additional or different privacy notices that are specific to certain features, services, programs, or activities, including notices provided to job applicants, employees, and participants in our training programs. Where such a notice conflicts with this policy, that notice governs the information it covers.

Please read this policy carefully to understand our policies and practices regarding your information and how we treat it. By interacting with our Services or providing us with your information, you agree to the collection, use, and disclosure of your information as described in this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Services after we make changes as described here is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Children's and Minors' Data

Our Services are not intended for, and we do not knowingly collect any personal data from, children under the age of 18. If we learn we have collected or received personal data from a child under 18 years old without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us using the information in the Contact Information section below.

The Personal Data That We Collect or Process

"Personal data" is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, or any other identifier we may use to contact you online or offline.

The types and categories of personal data we collect or process include:

  • Contact information, including your name, postal address, email address, telephone number (including mobile phone number), and other contact information you provide to us.
  • Professional and background information, including the position or program you are applying for, your state of residence, and the responses you provide to our application questions, which may include education level, degrees and certifications, work experience, skills and areas of technical interest, work authorization status, security clearance eligibility, and willingness to relocate. We do not collect résumés through the Services; if you later provide one during our hiring process, it is governed by our applicant and employee privacy notices.
  • Business contact information, if you interact with us on behalf of a current or prospective client, partner, or vendor, including your employer, job title, and business contact details.
  • Communications and content, including information you provide when you contact us, complete a form, respond to a survey, register for an event or webinar, or otherwise communicate with us, and any content you elect to submit through the Services.
  • Device and technical information, including your IP address, device identifiers, operating system and version, browser type and settings, preferred language, referring URLs, and other device and connection information.
  • General location information, such as the country, state, or city associated with your IP address. We do not collect precise geolocation through the Services.

Some of the information identified above, including work authorization or immigration status and, in some cases, military or veteran status, may be considered sensitive data under certain laws. Where required under applicable law, we will collect and process sensitive personal data only with your consent or as otherwise permitted by law. If you choose not to provide or allow us to collect some information, we may not be able to provide you with requested features, services, programs, or information.

We also collect:

  • Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific feature of the Services or the number of applicants to a particular program.
  • Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), pages and programs that you view or search for, page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from a page.

If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal data.

How We Collect Your Personal and Other Data

You Provide Information to Us

We collect information about you when you interact with our Services, such as when you complete a contact, inquiry, or online application form; express interest in a training program or job opportunity; register for an event or webinar; subscribe to communications from us; provide your mobile phone number to receive text messages; or otherwise communicate with us through the Services.

Automatically Through Our Services

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect information that may include personal data. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies, web beacons, and other tracking technologies, including details of your interactions with our Services, such as traffic data, general location data, logs, and other communication data, and the resources and features of the Services that you access and use.

Using automatic collection technologies helps us to improve our Services and to deliver a better and more personalized experience. The technologies we use for this automatic data collection may include:

  • Cookies. A cookie is a small file placed on your device when you interact with the Services. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Services.
  • Web Beacons. Some parts of the Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those parts or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).
  • Analytics and tag management tools. We use third-party analytics services, such as Google Analytics, and related tag management tools to understand how visitors use the Services and to measure the performance of our content and campaigns.

When you interact with the Services, there are third parties that may use automatic collection technologies to collect information about you or your device. These third parties may include analytics companies; embedded content providers (such as video hosting or scheduling tools); your device manufacturer; and your internet or mobile service provider.

These third parties may use tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your personal data, or they may collect information, including personal data, about your online activities over time and across different websites, apps, platforms, and other online services. We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

To the extent any of these automated technologies are considered a personal data "sale," "sharing," targeted advertising, or profiling under applicable laws, depending on where you live, you may opt out from use of these technologies for such purposes as described in Your Rights and Choices About Your Information below. Please note that some features of the Services may be unavailable as a result.

From Business Partners and Service Providers

We may receive personal data about you from other sources and combine that with information we collect directly from you. For example, we may obtain information about you from service providers that we engage to perform services on our behalf, such as email and marketing platform providers, applicant tracking and customer relationship management systems, event and webinar platforms, analytics providers, and security and anti-fraud services. We may also receive information about you from professional networking and job-board platforms (such as LinkedIn or Indeed) when you apply to or express interest in a SkillStorm opportunity through those platforms, and from publicly available sources.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal data, to:

  • Provide you with the Services and any contents, features, information, programs, or services that we make available through the Services.
  • Evaluate your interest in, and your qualifications for, SkillStorm training programs, job opportunities, and client engagements; communicate with you about the application and selection process; and, if you are selected, onboard you into the applicable program or role.
  • Respond to your inquiries and requests, and provide customer and candidate support.
  • Fulfill any other purpose for which you provide it.
  • Communicate with you by telephone and text message about your inquiry or application and about job opportunities, including, where you have given the separate consents described in Telephone Calls and Text Messages below, by automated text message and by calls that use an automatic dialing system or a prerecorded, artificial, or AI-generated voice.
  • Improve our Services, including by analyzing your information and creating aggregated data derived from your information, to develop, maintain, analyze, improve, optimize, measure, and report on our Services, programs, and features and how users interact with them.
  • Promote our Services, programs, and offerings, including by measuring the effectiveness of our recruiting and marketing campaigns. We do not sell your personal data or use it for cross-context behavioral advertising.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • Notify you about changes to our Services or any programs or services we offer or provide through them.
  • Comply with legal and regulatory obligations, including those applicable to government contracting, and protect the security and integrity of the Services.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

The usage information we collect, whether connected to your personal data or not, helps us improve our Services and deliver a better and more personalized experience by enabling us to estimate our audience sizes and usage patterns; store information about your preferences, allowing us to customize the Services according to your individual needs and interests; speed up your searches; and recognize you when you return to our Services.

We may also use your information to contact you about programs and services that may be of interest to you. If you do not want us to use your information in this way, you may opt out as described in Your Rights and Choices About Your Information below.

Large Language Model Training Disclosure: We do not use personal data collected through the Services to train large language models or other generative artificial intelligence models.

Who We Disclose Your Information To

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may also disclose personal data that we collect or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our organization, such as hosting, applicant tracking, customer relationship management, email and text messaging, analytics, event, and IT and security providers, and who are bound by contractual obligations to keep personal data confidential and use it only for the purposes for which we disclose it to them.
  • To our current and prospective clients and their designees, where you have applied to or expressed interest in a program or engagement in which SkillStorm places or deploys talent with that client, to the extent necessary to evaluate and facilitate that placement.
  • To background-check, drug-screening, and security-clearance processing providers, where you have been offered or accepted a position or program that requires such screening and you have provided any separately required consent.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of SkillStorm Commercial Services, LLC's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by SkillStorm Commercial Services, LLC is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal data:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Use and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of SkillStorm, our clients, our program participants, or others.

The categories of personal data we may disclose for these purposes include contact information; professional and background information; business contact information; communications and content you provide to us; device and technical information; and general location information.

We do not sell your personal data, and we do not disclose your mobile phone number or SMS consent information to third parties or affiliates for their marketing or promotional purposes.

Telephone Calls and Text Messages

Telephone calls. When you provide a telephone number on one of our forms, a SkillStorm representative may call you about your inquiry or application. Where you have separately checked the box consenting to automated calls, we may also call you using an automatic telephone dialing system or a prerecorded, artificial, or AI-generated voice. Calls that use an AI-generated voice will identify themselves as such at the start of the call. Consent to automated calls is never a condition of applying for or obtaining employment or a program placement, and you may revoke it at any time by any reasonable method, including by telling a representative on a call, replying STOP to a text message, emailing privacy@skillstorm.com, or calling 904-438-3440 and asking to be placed on our internal Do Not Call list. We keep a record of your consent and of any revocation. Calls may be recorded for quality, training, and compliance purposes where permitted by law; you will be told at the start of any recorded call.

Mobile/SMS Privacy

When you provide your mobile phone number to SkillStorm, you consent to receiving text messages from us as described in this policy and our Text Messaging Terms & Conditions.

How We Collect Mobile Information. We collect your mobile phone number when you voluntarily provide it to us through our Services, forms, applications, or other communications.

How We Use Mobile Information. We use your mobile phone number to send you customer care text messages related to our services, including but not limited to account notifications, service updates, appointment and interview reminders, and responses to your inquiries.

Mobile Information Sharing. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. We do not sell, rent, or lease your mobile phone number or SMS consent information to any third parties. Your mobile information may only be shared with service providers that assist us in delivering text messages, solely for that purpose.

Consent. By providing your mobile phone number, you expressly consent to receive text messages from SkillStorm as described herein. Your consent is not a condition of purchasing any goods or services from us.

Opt-Out of Text Messages. You have the right to opt out of receiving text messages from SkillStorm at any time. To stop receiving text messages, reply STOP to any text message you receive from us. After you send STOP, we will confirm your unsubscription with a final message. Once you opt out, you will no longer receive text messages from us. If you wish to re-subscribe, you may do so by contacting us directly.

Your Rights and Choices About Your Information

This section describes mechanisms you can use to control certain uses and disclosures of your information and rights you may have under state law, depending on where you live.

Cookies and other tracking technologies choices:

  • Cookies and Other Tracking Technologies. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. If you disable or refuse cookies or similar tracking files, some features of the Services may be inaccessible or not function properly. You can also opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on. Some browsers include a "Do Not Track" (DNT) setting that can send a signal to the online services you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Services may not respond to all browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls described in this policy and the Global Privacy Control described below.
  • Marketing Communications by SkillStorm. If you do not wish us to use your information to contact you about our programs and services, you can opt out by following the unsubscribe instructions in any marketing email we send, by replying STOP to any text message, or by sending us an email stating your request to privacy@skillstorm.com. Please note that we may still send you non-promotional communications, such as messages about an application or program in which you are participating.
  • Third-Party Advertising. We do not sell your personal data or disclose it to unaffiliated third parties for their own marketing purposes. We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Your State Privacy Rights

Depending on your state of residency, you may have certain rights related to your personal data, including:

  • Access and Data Portability. You may confirm whether we process your personal data and access a copy of the personal data we process. To the extent feasible and required by the law of your state, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information, and it will be included in the response to your access request.
  • Correction. You may request that we correct inaccuracies in your personal data that we maintain, taking into account the information's nature and processing purpose.
  • Deletion. You may request that we delete personal data about you that we maintain, subject to certain exceptions under applicable law.
  • Opt Out of Sales, Targeted Advertising, and Profiling. You may request that we not use your personal data for sales, targeted advertising, or profiling in furtherance of decisions that produce legal or similarly significant effects. We do not sell personal data or engage in such profiling; to the extent our use of third-party analytics or advertising tags constitutes "sharing" or targeted advertising under the law of your state, you may opt out as described below.

Important: The exact scope of these rights varies by state. There are also several exceptions under which we may not have an obligation to fulfill your request, and we may need to verify your identity before responding. You may designate an authorized agent to make a request on your behalf, subject to our verification of the agent's authority.

To appeal a decision regarding a consumer rights request, reply to our response with the word "Appeal" in the subject line within 45 days of receiving it, and we will respond as required by applicable law. We will not discriminate against you for exercising any of these rights.

Some browsers and browser extensions support the Global Privacy Control ("GPC") that can send a signal to process your request to opt out from certain types of data processing, including data "sales" and "sharing" as defined under certain laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

Nevada provides its residents with a limited right to opt out of certain personal data sales. Residents who wish to exercise their sale opt-out rights may submit a request to privacy@skillstorm.com. However, please know we do not currently sell data triggering that statute's opt-out requirements.

How We Protect Your Personal Data

We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Services. In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communication channels. Any transmission of personal data is at your own risk.

The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access, including by safeguarding any credentials you use to access the Services.

How We Retain Your Personal Data

We keep the categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described or as otherwise legally permitted or required, such as maintaining the Services, operating our organization, considering you for current and future programs and opportunities, complying with our legal, contractual, and recordkeeping obligations (including those applicable to government contractors and to employment and applicant records), resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and the nature of the information when deciding how long to retain personal data. At the end of the retention period, personal data will be deleted, destroyed, or deidentified.

Changes to Our Privacy Policy

We may update this policy from time to time, and we will provide notice of any such changes to the policy as required by law. The date the privacy policy was last updated is identified at the top of the page. We will notify you of changes to this policy by updating the "last updated" date and posting the updated policy on the Services. If we make material changes to how we treat our users' personal data, we will also post a notice on the home page of our website. We may email or otherwise communicate reminders about this policy, but you should check our Services periodically to see the current policy and any changes we have made to it.
